TM Machine Products, Inc. warrants that all of the products are free from defects in material and workmanship. This limited warranty shall apply for a period of one year from the date of purchase and shall cover only the original purchaser. Our obligation under this warranty is limited to the repair of replacement of the product. Any part used in racing applications
Any product that has been physically altered or improperly installed or maintained

TM Machine Products, Inc. will not be responsible for incidental and consequential damages, property damage, or personal injury/damage to the extent permitted by law. There is no implied warranties of merchantability or fitness for a particular purpose. There are no warranties which extend beyond the description on the face hereof. Some states do not allow a limitation on how long an implied warranty lasts or do not allow the exclusion or limitation of consequential damages, so those limitations and exclusions may not apply to all customers. This limited warranty gives you specific legal rights and you may also have other legal rights which vary from state to state.

All orders are shipped FOB shipping point Valencia, CA. All orders that are placed Monday-Friday by 12:00 PM (PST)-Pacific Standard Time for in-stock items will be shipped the same day (date of shipment not shipment method). All other orders will be shipped the next business day (date of shipment not shipment method) or when item(s) for the order become available. TM Machine Products, Inc. reserves the right to ship partial orders. If additional orders are called in the same day your order is placed, TM Machine Products, Inc. cannot guarantee that all items will ship with the original order or that additional applicable shipping and handling charges will not apply. TM Machine Products, Inc. cannot guarantee the availability of any items. All items under 150 lbs. are shipped UPS ground unless otherwise specified at the time of ordering. All items over 150 lbs. are shipped by truck. Special second day air and next day air shipments are available at an extra charge when your order is pre-paid in full prior to shipment. All orders are subject to an $8.50 packaging and handling charge. All shipments outside of the USA require pre-payment in full using US funds. All drop shipments are subject to a charge of $25.00. Dealer/distributor orders of $2,500 or more qualify for free freight (FOB shipping point Valencia, CA), some restrictions may apply, contact TM Machine Products, Inc. sales department for details. All shipments are fully insured. Any claim for damage must be made to the freight carrier. Do not return damaged merchandise to TM Machine Products, Inc. unless requested to do so. Please contact us at 800-733-4463 if you need assistance. All customers which refuse a shipment are subject to a $25.00 processing charge, to and from shipment charges (including packaging and handling), and any applicable charges or penalties made by the freight company. These charges must be paid before any further TM Machine Products, Inc. orders are processed.

No returns accepted are without pre-approved RGA (return goods authorization) number clearly marked on the outside of the box. No returns accepted after 90 days from date of original shipment. All returns after 10 days are subject to a restocking fee up to 25%. Before you return a product, contact our service department M-F 8AM-5PM (PST) at 800-733-4463 or E-Mail us for an RGA number. Returns made without prior authorization will be refused. All returns must be made within 30 days from date of original shipment, safety packaged in original packaging (if available as in-transit damage is not covered by our limited warranty), have the RGA number clearly marked on the top and two sides of the box and be insured for full replacement value.
All items to be returned must be approved in advanced and accompanied by your RGA (return goods authorization number). All returns must be made within 90 days of the original shipment date. All returns may be subject to a restocking fee up to 25%. The balance will be returned in the form of a check or may be applied as TM Machine Products, Inc. credit towards another order. Special orders and electrical components are not eligible for returns. If you need to return an item, we recommend using UPS, FedEx or The UPS Store. Before returning an item, be certain it is packed in a protective carton with the RGA number on the top and two sides on the box (save your original packaging for this purpose). If needed, TM Machine Products, Inc. can supply you with premium packaging materials (at customer's expense) as in-transit damage is not covered by our limited warranty. TM Machine Products, Inc. recommends that you insure your shipments for full replacement value.

To be effective, a Counter Notification must be a written communication provided to the Service Provider's Designated Agent that includes substantially the following:
A physical or electronic signature of the Subscriber;
Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;
A statement under penalty of perjury that the Subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled;
The Subscriber's name, address, and telephone number, and a statement that the Subscriber consents to the jurisdiction of Federal District Court for the judicial district in which the address is located, or if the Subscriber's address is outside of the United States, for any judicial district in which the Service Provider may be found, and that the Subscriber will accept service of process from the person who provided notification or an agent of such person
Upon receipt of a Counter Notification containing the information as outlined in 1 through 4 above:
Service Provider shall promptly provide the Complaining Party with a copy of the Counter Notification;
Service Provider shall inform the Complaining Party that it will replace the removed material or cease disabling access to it within ten (10) business days;
Service Provider shall replace the removed material or cease disabling access to the material within ten (10) to fourteen (14) business days following receipt of the Counter Notification, provided Service Provider's Designated Agent has not received notice from the Complaining Party that an action has been filed seeking a court order to restrain Subscriber from engaging in infringing activity relating to the material on Service Provider's network or system.
